By downloading, accessing, or using an App, you agree to be bound by these Terms. If you do not agree, you must not use the App. BeatCadenz and ChordMuse Flow have their own terms: [BeatCadenz Terms](/beatcadenz-terms) and [ChordMuse Flow Terms](/flow-terms). --- ## 1. Eligibility - The Apps can be used by people of all ages. - If you are under 18, a parent or guardian must agree to these Terms for you and is responsible for any purchases made on your device. ScaleCraft's children's courses are designed to be used with an adult's involvement. - By using an App, you confirm that you meet these requirements. --- ## 2. Use of the Apps - The Apps are provided for **personal, non-commercial use** only. - You agree not to: - Reverse engineer, copy, or redistribute an App. - Get around, disable or interfere with an App's trial, purchase or licence checks. - Use an App in a way that disrupts or harms other users. --- ## 3. Purchases, Trials and Subscriptions - All purchases are made through the Apple App Store, Google Play or the Microsoft Store, and are processed by them. Their terms, pricing and refund policies apply. We never receive your payment details. - Prices are set per region and shown by the store before you buy. - **Free trials.** Where an App offers a free trial, it can be used once. It ends by itself at the end of the trial period; nothing is charged and nothing renews unless you choose to buy. - **One-time purchases.** A one-time purchase is charged once and does not renew. It can be restored on other devices signed in to the same Apple Account or Google Account using Restore purchases in the App. A purchase that is refunded or revoked by the store is removed from the App. - **Subscriptions.** Where an App offers a subscription, it renews automatically unless cancelled at least 24 hours before the end of the current period, in your App Store or Google Play account settings. - **ChordMuse:** after its free trial, its features require an in-app purchase. - **ScaleCraft (iPhone, iPad and Android):** free to download. A free tier stays free. Every feature can be tried free for 30 days, once; on iPhone and iPad the trial is tied to your Apple Account, and on Android it is recorded against your device (see the ScaleCraft privacy policy), so removing the App or clearing its data does not give you a further trial. **Full Unlock** is a one-time purchase that opens every feature. When a trial ends without a purchase, your progress is kept and the free tier stays open. On Windows, ScaleCraft is a paid app with every feature included. --- ## 4. Intellectual Property - All content within the Apps, including code, design, branding, lessons, music and theory modules, is owned by us or licensed to us. - You may not reproduce, distribute, or create derivative works from it. --- ## 5. User Content - Some features let you create or save content (for example progressions, recordings, practice logs and progress). - You keep ownership of this content, and give the App permission to store and process it on your device so the App can work. - We are not responsible for loss of your content. Please back up recordings or files externally, or with an App's backup feature where it has one. --- ## 6. Disclaimer of Warranties - The Apps are provided on an **"as is"** and **"as available"** basis. - We do not guarantee uninterrupted, error-free, or bug-free operation. - Music theory content, lessons and suggestions are for **educational and creative purposes only**. --- ## 7. Limitation of Liability - To the fullest extent permitted by law, we are not liable for: - Any indirect, incidental, or consequential damages. - Loss of data, profits, or goodwill arising from your use of an App. - Nothing in these Terms excludes rights you have under the Australian Consumer Law or other laws that cannot be excluded. --- ## 8. Termination - We may suspend or terminate your access to an App if you breach these Terms. - Upon termination, your right to use the App will immediately cease. --- ## 9. Changes to These Terms - We may update these Terms from time to time. The date at the top shows when they last changed. - Continued use of an App after changes means you accept the revised Terms. --- ## 10. Apple's Standard Licence - On Apple devices, your licence to use an App is also governed by Apple's standard [Licensed Application End User License Agreement](https://www.apple.com/legal/internet-services/itunes/dev/stdeula/). --- ## 11. Governing Law - These Terms are governed by the laws of **Australia**, without regard to conflict of laws. - Disputes will be handled in the courts of **NSW, Australia**. --- ## 12.
