These Terms of Service ("Terms") govern your use of BeatCadenz, operated by Webfascia Digital Solutions ("we", "us", or "our"). By downloading, accessing, or using BeatCadenz, you agree to be bound by these Terms. If you do not agree, you must not use the App. --- ## 1. Eligibility - All age groups are eligible to use the App. - By using the App, you confirm that you meet these eligibility requirements. --- ## 2. Use of the App - The App is provided for **personal and commercial use**. - You may use audio exported from the App in your creative projects, including commercial works, without royalty payments. - You agree not to: - Reverse engineer, copy, or redistribute the App itself. - Redistribute the bundled audio assets, drum patterns or MIDI grooves as standalone samples, sample packs or loop libraries. - Use the App in a way that disrupts or harms other users. --- ## 3. Royalty-Free Audio License - All audio created and exported using BeatCadenz is **royalty-free**. - You may use exported audio in: - Personal projects - Commercial music productions - Videos, podcasts, and streaming content - Games and interactive media - Any other creative works - You may NOT resell or redistribute the raw audio assets, samples, MIDI grooves or drum patterns included in the App. --- ## 4. Recording and Content You Import The App records audio through your microphone or a connected audio interface, and lets you import backing tracks, samples and other audio files. - **You are responsible for what you record and import.** You must have the right to record and use that material — including any copyrighted recording, backing track or performance by someone else. - Recording other people requires their consent, and you must comply with the recording and privacy laws that apply where you are. - Importing a commercial track for practice or overdubbing does not give you the right to publish or distribute the result. The royalty-free licence in Section 3 covers the App's own bundled content and what you create with it — not third-party material you bring in. - We do not review, moderate or receive your recordings; they stay on your device unless you choose to share them. --- ## 5. Sharing Projects and Exports - Sharing a recording, mix, MIDI loop or project bundle hands the file to your device's share sheet. Where it goes next is your choice and is governed by that service's terms. - A shared project bundle contains the project **along with its media and samples**. Anything you recorded or imported into that project travels with it. Share accordingly. - You are responsible for ensuring you have the right to share what you send, and for what you receive from others. --- ## 6. Connected Hardware and Third-Party Plugins - The App connects to USB and Bluetooth MIDI controllers and to external audio interfaces. Compatibility depends on your hardware and operating system, and we do not guarantee that any specific device will work. - On Apple devices, the App can host third-party AUv3 instruments and effects that you have installed. **Those plugins are separate products made by other developers**, governed by their own terms and licences. We do not control them, do not support them, and are not liable for their behaviour, output, stability or licensing. - Monitoring a live input through a device's built-in speaker is disabled to prevent feedback. You are responsible for using suitable headphones or monitoring equipment, and for protecting your hearing when monitoring at volume. --- ## 7. Intellectual Property - All content within the App, including code, design, branding, and audio assets, are owned by us or licensed to us. - You may not reproduce, distribute, or create derivative works of the App itself. - Exported audio you create is yours to use under the royalty-free license described in Section 3. --- ## 8. User Content - The App allows you to create and save projects, recordings, samples, amp rigs and exports. - You retain ownership of your projects, your recordings and anything you create with the App. - All of it is stored locally on your device. **We are not responsible for loss of your content** — including loss caused by device failure, uninstalling the App, clearing app data, or an operating system update. Please back up important projects and recordings externally. --- ## 9. Free Features, Trial and Full Unlock - **Free.** BeatCadenz is free to download. These features stay free with no purchase: Beat Maker, Ensemble and Live Loop (up to two projects of each), Step Sequencer (up to two saved patterns), Drum Pads, Audio Trimmer, MIDI controller connection and MIDI mapping, the built-in sounds, Compositions, search and the in-app guides. Free projects can be played, recorded, rendered and exported in full. - **Premium features.** Amp Lab, Sampler, Karaoke, Melody Player, Grooves Hub, Backing Tracks, Virtual Piano, the Sound Pack library, and more than two projects of each type or saved Step Sequencer patterns, are available during the free trial or after Full Unlock. Features added in future may be free or premium. - **30-day free trial.** You can start a free trial of every premium feature once. It lasts 30 days from when you start it and then ends by itself. Nothing is charged and nothing renews. On the Apple App Store the trial is a free in-app item tied to your Apple Account. On Google Play it is recorded against your device (see the Privacy Policy), so removing the App or clearing its data does not give you a further trial. - **Full Unlock.** Full Unlock is a single, one-time, non-consumable in-app purchase that permanently unlocks every premium feature for the Apple Account or Google Account that bought it. It is not a subscription and does not renew. Use **Restore purchases** in the App to restore it on another device signed in to the same account. - **When a trial ends.** Everything you made is kept. Projects over the free limits still open and play; you can't add more until you are under the limit or have Full Unlock. - **Payment.** Purchases are processed by Apple (App Store) or Google (Google Play). We never receive your payment details. Prices are shown in the App, in your store's currency, before you buy. Refunds are handled by Apple or Google under their refund policies; we cannot issue refunds directly. - **Licence.** On Apple devices, your use of the App is also governed by Apple's [Licensed Application End User License Agreement](https://www.apple.com/legal/internet-services/itunes/dev/stdeula/) (the standard EULA). If these Terms conflict with that agreement, the standard EULA applies to the extent of the conflict. - The App does not require an account or a subscription. --- ## 10. Disclaimer of Warranties - The App is provided on an **"as is"** and **"as available"** basis. - We do not guarantee uninterrupted, error-free, or bug-free operation. - Audio content is provided for **creative and practice purposes**. - Real-time audio performance, latency and input compatibility depend on your device, your operating system and any connected hardware, and are not guaranteed. --- ## 11. Limitation of Liability - To the fullest extent permitted by law, we are not liable for: - Any indirect, incidental, or consequential damages. - Loss of data, recordings, projects, profits, or goodwill arising from your use of the App. - Damage to hearing or equipment arising from monitoring or playback at unsafe volume. --- ## 12. Termination - We may suspend or terminate your access to the App if you breach these Terms. - Upon termination, your right to use the App will immediately cease. --- ## 13. Changes to These Terms - We may update these Terms from time to time. - Continued use of the App after changes means you accept the revised Terms. --- ## 14. Governing Law - These Terms are governed by the laws of **Australia**, without regard to conflict of laws. - Disputes will be handled in the courts of **NSW, Australia**. --- ## 15.
